根據香港報紙報導:香港首宗以刑事檢控「包攬訴訟」案件昨日在區域法院宣判。涉案女事務律師及其女助手,以「不成功不收費」剝奪一宗車禍傷亡申索的其中86萬餘元賠償作為報酬,早前被裁定「包攬訴訟」和「助訟」罪成,分別被判入獄16及15個月。案情指,車禍於2001年3月6日發生,青年楊駿傑遇上交通意外嚴重傷殘。意外後,楊母黃少英到醫院探望兒子期間,首被告向黃搭訕,稱可幫助她追討意外賠償,指明若索償失敗不會收費,但若成功,則須付賠償額的25%為服務費。
Hawaiian現在才知這是在香港是犯法,在美國不知是否一樣呢?因為經常在中文報紙看到類似的廣告:某某律師為工傷車禍…..等等索償,不成功不收費.Hawaiian讀報,很少理會廣告,除非想買一件物品或想做一件事.故不知這些廣告內容是否合法?
Hawaiian又想起一事,友人十幾年前做腦部手術,機會係五五波.之前己簽下生死狀,一切後果無需醫生負責.結果手術成功,但有後遺症,右手右腳軟弱無力,尤如中風後一樣.醫生憐憫其家貧,把廿多萬美元手術費全免.後來有幾個律師多次上門勸友人告該醫生,聲明不成功不收費.友人話:你想我做不仁不義的人嗎?把這些律師斥退.Hawaiian很想知道,上述這些律師是否犯法?希望知道美國法律的人解答,先謝過!

Hi Hawaiian:

I believe "Contingency Fees" are allowed in all states and territories of the United States. Lawyers whose practices consist mainly of this type of business are derogatorily known as "ambulance chasers" (it is only half joking to say that these lawyers follow ambulances from accident scene to the hospital so that they can hard sell their services to the victim or surviving family). They drum up business by actively soliciting people to file law suits, often creating arguments out of thin air. Contingency fees do encourage people to file frivolous and vexatious law suits at a minimal cost for possible large future awards or settlements, or just for the sake of stirring up trouble and entangling the defendants in legal quagmire. The U.S. is perhaps the most litigious country in the world, contingency fee may be a huge contributing factor. As far as I understand it, the advertisements you see in the newspapers are quite legitimate. But I stand to be corrected if some U.S. lawyers can comment on it.

Some common law jurisdictions prohibit contingency fee.

Some other jurisdictions allow for contingency fees despite its shortfall. The reasoning behind the relaxation of outright prohibition is that a plaintiff who has genuine grievance that exceeds the small claims court limit or authority (e.g. equity cases) but cannot afford a lawyer, yet not poor enough to qualify for legal aid (i.e. most of the middle class), should be allowed an avenue to have their matters tried by a court.

A safeguard against the abuse of the contingency fee arrangement is that the court be granted the authority to charge and penalise the plaintiff and his attorney if the court determines that the suit filed has no merit and is plain obnoxious in nature.

May be someone in other common law countries can enlighten us on the issue of contingency fees in their countries.

多謝你的意見及回應,美國每個州的法律不同,加上律師中也有良莠不齊,可能有法律罅鑽.不過話又說回頭,美國有些法律會令人啼笑皆非,甚至令人要嘔血的.
